Please read these Terms carefully before using WASME. By creating an account or using the app, you agree to be bound by these terms. If you do not agree, do not use WASME.
WASME is a location-based memorial application developed and operated by SABOTLAB INC, a Florida corporation ("Company," "we," "us," or "our"). These Terms govern your use of the WASME mobile application and website at wasme.app (collectively, the "Service").
By downloading, installing, or using WASME, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and SABOTLAB INC.
You must be at least 13 years old to use WASME. By using the Service, you represent that you are 13 or older and legally capable of entering into a binding agreement. If you are between 13 and 18, your parent or guardian must review and agree to these Terms on your behalf. We reserve the right to suspend or refuse accounts that do not meet these requirements. If we learn that a user under 13 has created an account, we will delete it promptly.
To use most features of WASME, you must create an account. You agree to:
You are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms or contain inaccurate information.
SABOTLAB INC grants you a limited, non-exclusive, non-transferable, revocable license to download and use the WASME app on your personal device solely for personal, non-commercial use. You may not copy, modify, distribute, reverse engineer, decompile, sublicense, or resell the app. This license is revocable at any time. Your use of the app is also subject to the terms of the Apple App Store or Google Play Store where applicable.
You agree to use WASME only for lawful purposes consistent with its intent as a platform for dignified remembrance. You agree not to harass, threaten, abuse, defame, or impersonate any person; post content promoting hate or violence; spam or scrape the Service; hack, disrupt, or circumvent any security controls; introduce malware; or infringe any intellectual property or privacy rights.
Your content is yours. WASME does not claim ownership of content you submit. By posting content, you grant SABOTLAB INC a non-exclusive, royalty-free, worldwide license to display, store, and distribute your content solely to operate the Service.
You are solely responsible for your content. By submitting content, you warrant that you own it or have all necessary rights; it does not infringe any third-party rights; you have the right to share information about the individuals depicted; and it is truthful and lawful.
Obituary copyright notice. Facts about a person — name, dates, places — are not copyrightable. The written expression of a published obituary may be. You may not paste verbatim obituary text from newspapers or funeral homes. You may share the same facts in your own words.
You agree not to post content that is false or fabricated about any deceased individual; harasses or defames any living person; contains copyrighted material without permission; glorifies violence or terrorism; is sexually explicit or inappropriate; targets minors; promotes hate; impersonates anyone; contains spam; or violates any law. We reserve the right to remove any content at our sole discretion.
Use the in-app report button to flag content that violates these Terms, or contact us at pedro@wasme.app. We review all reports and may remove content, warn users, or terminate accounts in response.
Family members or legal representatives of a deceased person may request removal, correction, or transfer of a memorial by contacting pedro@wasme.app. We will review all requests promptly and act in good faith.
Public memorials are visible to all WASME users. GPS coordinates are stored and displayed publicly. Do not place pins at private residential addresses without genuine memorial significance. Visitor messages are public and appear alongside your display name.
WASME, the WASME name, logo, app design, and code are the property of SABOTLAB INC, protected by copyright and trademark law. The WASME trademark is filed with the USPTO (Serial No. 99711289). Unauthorized use is prohibited. You may not copy, reproduce, or distribute any part of the Service without written permission.
If you believe content on WASME infringes your copyright, submit a takedown notice to our designated DMCA agent:

Your notice must include: your signature; identification of the copyrighted work; identification of the infringing material with enough detail to locate it; your contact information; a good faith statement that the use is not authorized; and a statement under penalty of perjury that you are authorized to act on behalf of the copyright owner. We will remove infringing content promptly. Counter-notices may be submitted to the same address; we will restore content within 10–14 business days unless legal action is initiated.
We will permanently terminate accounts of users who repeatedly infringe copyright or receive multiple valid DMCA takedown notices.
WASME does not currently offer paid features. All core features are free. If paid features are introduced in the future, we will update these Terms with full disclosure of pricing, billing, auto-renewal, cancellation, and refund terms before any charges apply. Future billing may be processed through the Apple App Store or Google Play Store.
WASME uses the following third-party services: Google Firebase (authentication, database, storage), Apple App Store / TestFlight (distribution), Expo / EAS (build services), and Apple Maps (map display). Each has its own terms and privacy policies. We are not responsible for their conduct or availability. Your use of WASME through app stores is also subject to those stores' terms.
We do not guarantee uninterrupted availability. The Service may change, pause, or be discontinued at any time. We may update these Terms at any time and will notify you of material changes through the app or by email. Continued use constitutes acceptance of updated Terms.
WASME is an interactive computer service under Section 230 of the Communications Decency Act. We are not liable for user-generated content but reserve the right to moderate and remove it at our discretion.
Your use of WASME is governed by our Privacy Policy at wasme.app/privacy, incorporated into these Terms by reference.
WASME is provided "as is" and "as available" without warranties of any kind, including merchantability, fitness for a particular purpose, or non-infringement. We do not verify the accuracy of user-submitted memorial content.
To the fullest extent permitted by law, SABOTLAB INC is not liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claims shall not exceed $100.
You agree to indemnify and hold harmless SABOTLAB INC, its officers, employees, and agents from any claims, damages, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.
We may terminate your account at any time. You may delete your account in the Profile section of the app. Upon termination, your access ceases immediately and your data is handled per our Privacy Policy. Public memorials remain unless deleted before termination. Visitor messages may remain associated with your display name. Sections 12, 13, 20, 21, 22, and 24 survive termination.
These Terms are governed by the laws of the State of Florida. Disputes shall be resolved in the state or federal courts of Osceola County, Florida. Before initiating legal action, contact us at pedro@wasme.app and attempt informal resolution for at least 30 days.

These Terms and our Privacy Policy constitute the entire agreement between you and SABOTLAB INC regarding WASME. If any provision is unenforceable, the remaining provisions remain in full force.
